Commercial Collections

Obtaining a judgment is sometimes just one step on the path of recovering amounts owed. Many times, debtors will not voluntarily pay a judgment, but will force the creditor to try to collect it. This leaves creditors with a choice: let the judgment remain just a piece of paper, or take action to collect it.

Many times, judgment debtors assume a creditor does not have the nerve or know-how to enforce a judgment and collect it. That’s where we come in.

We have significant experience in collecting non-consumer judgments, both for our clients and for other attorneys who want help getting their judgment collected. We have the resources (both internal and external) to locate assets and seize them from unwilling judgment debtors, using law enforcement, private process servers, and other resources. We understand that collecting a commercial judgment can come down to applying sufficient pressure in the correct location, and when done correctly can help a solvent judgment debtor decide that paying is better than running. We also understand that judgment debtors sometimes seek protection of the bankruptcy courts, and if a debt is not otherwise dischargeable in bankruptcy, we represent clients in adversary proceedings to preserve that judgment from the bankruptcy process.

NOTE: we limit our work in this area to debt and judgments for corporate, business, or agricultural purposes. We do not collect debts or judgments against consumers (i.e., amounts owed primarily for personal, family, or household purposes).
